This overlay zone is <br />intended to provide for the safe operation of the air- <br />port by limiting the height of structures and certain <br />land uses. The maximum surface height limit of build- <br />ings on the subject property is 195 feet above mean sea <br />level along the west side of the property, and 323 feet <br />above mean sea level along the east side of the subject <br />property. The elevation of the land on the subject <br />property is 190 feet, and therefore, allowable building <br />heights will range from 5 feet along the west side of <br />the property to 133 feet on the east side of the subject <br />property. Applicants indicate that the proposed addi- <br />tion would be less than 2& feet in height and within the <br />applicable height limits. <br /> <br />After reviewing all of the applicable criteria and the <br />evidence contained in the record, the Hearings Officer <br />concludes that the application for the proposed addition <br />should be approved, subject to conditions in the <br />interest of public safety. <br /> <br />VI. Order <br /> <br /> It is hereby found that the applicant has met the burden of <br />proving the relevant standards and criteria, and therefore, it is <br />ordered that the application for a Conditional Use is GRANTED, <br />subject to the conditions set forth below: <br /> <br />The Conditional Use Permit approved herein shall be <br />valid for a period of one year from the effective date <br />of this Order, unless a request for extension is made in <br />writing to the Hearings officer prior to the expiration <br />of the permit. <br /> <br />This Conditional Use Permit is limited specifically to <br />airport-related commercial use, as indicated in the <br />application and in the Findings of Fact stated above. <br />No other type of ~se, commercial or otherwise, shall be <br />permitted without seeking separate land use approval. <br /> <br />Prior to the commencement of any construction on the <br />subject property or the obtaining of any building <br />permits, applicants shall submit a site plan to the <br />Marion County Chief Planner for approval.
