NOTICE OF DECISION <br /> CONDITIONAL USE CASE NO. 83-17 <br /> <br />Notice is hereby given that the PlannTng Director for Marion County(n~ <br />the following described Conditional Use application. The findings ano <br />sions on which the Director based his decision are noted below. <br /> <br />APPLICATION: <br /> <br />App ication of Kati~rtil~a to locate a ~obile home during <br />a family hardship si'[~i'~ on 66.5 acres ,n an EFU (Exclusive <br />Farm Use) zone (Section 136.030(c) of the Marion County Zoning <br />Ordinance) and in the Airport Overlay~ zone [Se~.~tion ]7_~.040(c)) <br /> <br />Aurora (Sec. ~6, T4S, R1W). "~--- <br /> <br />FINDINGS AND CONCLUSIONS: Denial was based upon the following findings and con- <br />clusio~s: <br /> <br />The subject property is 66.5 acres in size and is zoned EFU (Exclusive <br />Farm Use) and is designated Primary Agriculture on the acknowledged <br />Marion County Comprehensive Plan. The property is also located within <br />the Conical Surface of the Aurora Airport Overlay zone. <br /> <br />The applicants, who reside on the subject property wish to locate an <br />additional mobile home on their property so their son and daughter-in-law <br />may reside there also. They indicate that they can no longer farm the <br />property and they need their son to maintain the land and their daughter- <br />in-law ~o take care of them· <br /> <br />There is a provision in the EFU zone to allow for the temporary placement <br />of a mobile home during certain family hardship situations provided spec- <br />ific criteria and conditions have been met. <br /> <br />Section llg. IO0(A) of the Marion County Zoning Ordinance empowers the <br />Planning Director to. render decisions on this type of request_ <br /> <br />A signed Physician's Certificate has been submitted for Mr. Hat,ilia which <br />indicates that.he has a medical condition which requires periodic care and <br />attention and that would preclude him from maintaining a complete, separate <br />and detached residence apart from his family. No such certificate has been <br />submitted for Mrs. Martilla, however, information was submitted which does <br />indicate that she has medical problems. <br /> <br />In July of 1978 a permit was issued, to locate a mobile home on the subject <br />property for another of the Martilla~s SOnS to reside in. The permit was <br />issued because the son was needed to provide labor for.the Parm. The mobil~ <br />home was sited in August of 1978. <br /> <br />It is the intent of the EFU zone and the primary agriculture designation to <br />provide areas for the continued practioe of commercial 'agr|culture and to <br />minimize the intrusion of non-farm uses and dwel]ings. The placement of <br />additional dwellings :is generally not considered compatible with farm uses, <br />unless the dweiling is necessary for additional farm help, or it's placement <br />meets the requirements for a temporary hardsh|p. <br /> <br /> <br />
