Re: WQ- SDS-Variance Approval T,L. 90190-400; Sec. 13; T. 4 S.; R. 1 W., W.M.; Marion County Dear Mr. Smith: This correspondence verifies that an information gathering hearing, provided for under Oregon Administrative Rule (OAR) 340-71-430, was held in Marion County on April 20, 1989, to consider your request to waive certain rules regulating on-site sewage treatment and disposal. Based upon field observations and findings cited below, I am please to advise you that your request for variance from the following on-site rules are granted: OAR 340-71-205(5) ~- which requires the maintenance of all setbacks between the sewage disposal system and the new mobile home, and that there be sufficient area available to completely replace the absorption facility. OAR 340-71-220(2)(i)(Table 1)(12) -- which requires the replacement absorption facility maintain a ten (10) foot separation distance from the mobile home, The property is rectangular in shape, with dimensions of 55 feet by 90 feet. The existing sewage disposal system consists of a steel 750 gallon septic tank and approximately 76 feet of disposal trench. No indication of system malfunction was observed. A pit dug in the area of the proposed repair/replacement area exhibited soil textures of loam over silt loam over very fine sandy loam, with no sign of conditions associated with saturation to a depth of 57 inches. A water meter and water pipe are located in the proposed repair/replacement area, and would need to be relocated to the north property line if system repairs became necessary. gased upon my review and evaluation of the variance record, it is my opinion that strict compliance with the above-cited rules is inappropriate. The existing system appears to be functioning without indications of failure.
