DON WOODLEY <br />AUGUST 10, 1992 <br />PAGE 2 <br /> <br />QUESTION 3: WHAT IS THE MINIMUM SETBACK FOR AN ACCESSORY BUILDING <br />FROM THE EDGE OF A PARK STREET OR FROM THE' EDGE OF A SIDEWALK ALONG <br />A PARK STREET?. THIS ISSUE IS NOT ADDRESSED BY RULE. <br /> <br />ANSWER: As you have correctly noted, there currently exists no <br />minimum standard established for the setback of accessory buildings from <br />park streets and sidewalks in the current administrative rules. Therefore, the <br />minimum setback is (0) zero as long as the accessoW building does not <br />encroach on the park street or sidewalk. <br /> <br />QUESTION 4: IF A LESSER DISTANCE BETWEEN ACCESSORY STRUCTURES IS <br />DESIRED, MAY WE USE FIRE WALLS TO MITIGATE THE FIRE DANGER? <br /> <br />ANSWER: YES. ORS 446,062,(2) states in part "Manufactured dwelling <br />parks are subject to the statute, the state building code and the rules <br />adopted by the Agency." Since the OregOn Structural Specialty Code is part <br />of the state building code, it may be used to reduce minimum separations <br />required in OAR 918-600-050 (see attached). <br /> <br />QUESTION $: WERE THE MANUFACTURED DWELLING PARK ADMINISTRATIVE <br />RULES INTENDED TO BE A MINIMUM-MAXIMUM CODE? <br /> <br />ANSWER: YES. ORS 446.062 and 446.100(a) charges the Building <br />Codes Agency with the responsibility of creating statewide regulations for <br />the construction of manufactured dwelling parks. In addition, ORS 446,430 <br />and 446.072 requires the Agency to assure these regulations are carried out <br />consistently throughout the state; therefore, the legislature intended these <br />regulations to be both the minimum and maximum code for the construction <br />of manufactured dwelling parks in the state of Oregon. <br /> <br />The Agency is preparing to begin review of the Manufactured Dwelling Park Administrative <br />Rules in the fall of 1992.
