The Marion County Tax Assessor's Office indicates the property <br />is being specially assessed. All other contacted agencies <br />either failed to comment, or stated no objections to the <br />proposal at the time the report was written. <br /> <br />In order to approve a non-farm dwelling in an SA zone, the <br />applicant must demonstrate that: <br /> <br />(a) The proposed dwelling shall be the only dwelling on the <br /> subject property and contiguous property in the same <br /> ownership; and <br />(b) It shall be situated upon generally unsuitable land for <br /> farm use considering the terrain, adverse soil or land <br /> conditions, drainage and flooding, location and size of <br /> the parcel; and <br />(c) The use is compatible with farm uses and is consistent <br /> with the intent and purposes set forth in ORS 215.243; <br /> and <br /> ~t will not interfere seriously with accepted farming <br /> practices on adjacent lands devoted to farm use; and <br />(e) It will not materially alter the stability of the overall <br /> land use pattern of the area; and <br />(f) Adequate fire protection and other rural services are, or <br /> will be, available; and <br />(g) It will not have a significant adverse impact on timber <br /> production, grazing land, watersheds, fish and wildlife <br /> habitat, soil and slope stability, air and water quality, <br /> and outdoor recreation activities. <br /> <br />The proposed dwelling will be the only dwelling on the <br />property and the applicants own no adjacent parcels, the <br />proposal meets 8 (a). Comments received from the Division of <br />State Lands indicate that the majority, if not all the <br />property, is located in'a mapped wetlandl The parcel is <br />receiving special tax assessment, however, the applicant <br />indicates that the property, due to wetland, has never been <br />cultivated, the proposal meets 8 (b). The County has approved <br />non-farm dwellings to the east and north of the subject <br />property and there is very little or no farming on adjacent <br />properties. Approval of a non-farm dwelling on the property <br />will fit the established land use pattern area, the proposal <br />meets 8 (c), (d)~ & (e). The property is located in a rural <br />fire district and other services are available at the site, <br />the proposal meets 8 (f). There is no evidence that the <br />proposal will have any adverse impact on the resources in 8 <br /> (g). <br /> <br />Although the proposed dwelling is appropriate, the concerns <br />express by the Division of State Lands regarding wetlands must <br />be addressed. A conditioxl of approval will be added that will <br />require the applicant to provide written evidence that their <br />concerns are addressed. Also, the County requires that a <br />Declaratory Statement be recorded with the property deed. <br />This serves to notify the applicant and subsequent owners that <br /> <br /> <br />
