The applicant shall submit either evidence that the access <br />easement has been improved to the standards in Section VII(6) <br />of the Marion County Subdivision and Partitioning Ordinance or <br />submit a Roadway Improvement Agreement (Ordinance reference <br />and agreement enclosed). The roadway must be named and all <br />parcels in the subject application using the roadway for <br />access must be addressed using the new roadway name. The <br />access easement is also to provide for utilities. <br /> <br />The applicant shall sign and submit a Declaratory Statement to <br />the Planning Division. This statement shall be recorded by <br />the applicant with the Marion County Clerk after it has been <br />reviewed and signed by the Planning Director (Declaratory <br />Statement enclosed). <br /> <br />The applicant shall file a Statement of Water Rights, and <br />shall be shown on the final plat. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the <br />following conditions must be continually satisfied: <br /> <br />After the final Partitioning plat has been recorded no alter- <br />ation of property lines shall be permitted without first <br />obtaining approval from the Planning Director. <br /> <br />~THER PERMIT~,,~,,,,,,FEES, AND RESTRICTIONS: This approval does not <br />remove or affect any covenants or restrictions imposed on the <br />subject property by deed or other instrument. The proposed use may <br />require permits and/or fees from other local, State or Federal <br />agencies. This decision does not take the place of, or relieve the <br />responsibility for obtaining other permits or satisfying any <br />restrictions or conditions thereon. It is recommended that the <br />agencies mentioned in Finding #6 below be contacted to identify <br />restrictions or necessary permits. The applicant is advised of the <br />following: <br /> <br />Prior to obtaining building permits, the applicant shall <br />provide evidence of approval for the access from the Sublimity <br />Fire District. For personal and property safety 'it is <br />recommended that the applicant follow these guidelines. Fire <br />District access standards may be more restrictive than County <br />standards. <br /> <br />Ail or a portion of this property has been identified as being <br />located in a "Groundwater Limited Area" as defined by the <br />Oregon State Water Resources Department. The applicant is <br />advised to contact Water Resources (378-3739) regarding <br />possible restrictions or limitations on use of groundwater in <br />the area. <br /> <br /> <br />
