RECEIVED <br /> <br /> NOTICE OF DECISION <br />ADMINISTRATIVE REVIEW CASE NO. 96-23 <br /> <br /> JUN 1 7 996 <br />MAI~iON COUNTY <br />BUILDING INSPECTION <br /> <br />APPLICATION~ Application of Wesley and Elsie Mix for an Adminis- <br />trative Review to reduce the required 200 foot special agricul- <br />tural setback on a 2.32 acre parcel in an EFU (Exclusive Farm <br />Use) zone located at 10625 Mix Road SE, Aumsville. (Section 5; <br />Tgs; RIW). Tax Lot No. 60491-000 & 60493-000. <br /> <br />DECISION: NotiCe is hereby given that the Planning Director for <br />Marion County has APPROVED the submitted application subject to <br />the following conditions of approval: <br /> <br />This decision is valid only when exercised by <br />(two years from the effective date of the decision) <br />unless an extension is granted. The effective period of this <br />application may be extended for one year subject to approval of <br />an extension. Request for an extension must be submitted to the <br />Planning Division prior to expiration of the approval. (Exten- <br />sion form available from the Planning Division). <br /> <br />The applicant shall obtain all required building permits <br />from the Marion County Building Inspection Division prior to <br />placement of the dwelling. <br /> <br />The proposed dwelling shall be no closer than 80 feet from <br />the north and south property lines, and 130 from the west <br />property line and be placed as indicated on the plot plan. <br /> <br />A new Mobile Home Removal Agreement shall be signed, nota- <br />rized, and recorded for the existing dwelling. <br /> <br />The new mobile home shall become the permanent dwelling when <br />the hardship is no longer necessary and the existing mobile <br />home is removed. <br /> <br />Other Permits, Fees and Restrictions: <br /> <br />The applicants are advised that the use of the property proposed <br />in this application may require additional permits and/or fees <br />from other local, State or Federal agencies. The Marion County <br />land use review and approval process does not take the place of, <br />or relieve the applicants of responsibility for acquiring such <br />other permits, or satisfying any restrictions or conditions <br />thereon. <br /> <br />PROCEDURE: The Marion County Zoning Ordinance provides ~hat <br />Administrative Review applications be considered first by the <br />.County Planning Director. If there is any doubt that the appli- <br />cation conforms with adopted land use policies and regulations <br />the Director must deny the application. Any interested person <br />who disagrees with the Director's decision may appeal the deci- <br />sion to the Marion County Hearings Officer. <br /> <br /> <br />
