This decision is effective
unless appealed· '

FINDIngS A~D CO~CLUSIO~: The findings and conclusions on which
the Director based has decision are noted below.

The subject property is designated Primary Agriculture in
the Marion County Comprehensive Plan and is zoned EFU
(EXCLUSIVE FARM USE). The primary intent of the Comprehen-
sive Plan and zone designation is to promote the continua-
tion of commercial farm operations.

The subject property is located on the north side of Mix
Road approximately 600 feet east of its intersection with
Porter Road.

The subject parcel is surrounded on all sides by land which
is in farm use and zoned EFU. The predominate crops in the
vicinity are row crops and mint production. There are no
other dwellings clustered in the immediate vicinity of the
subject residence.

The applicants have requested to place a hardship mobile
home, which will become a permanent dwelling, that will be
within the required 200 foot setbacks from the property
lines. The placement of a non-farm dwelling is subject to
the requirements of 136.050. This section requires a
special dwelling setback of 200 feet from any abutting
parcel in farm use, unless the applicant is granted an
adjustment. The adjustment may be granted if it is deter-
mined that a lesser setback will prevent activities associ-
ated with the dwelling from seriously interfering with
farming on adjacent parcels.

The subject property was approved for the placement of a
temporary mobile home for medical hardship purposes on 12-
28-95 (CU95-76). The approved location of the hardship
mobile home was 20 feet from the north property line,
approximately 200 feet from the south, approximately 100
feet from the west, and over 200 feet from the east. The
existing dwelling is a 1973 Biltmore Deluxe mobile home and
is currently located in the southern portion of the parcel
approximately 50 feet from the Mix Road right-of-way.
Because of the small size of the subject parcel, any dwell-
ing located on the property must be located within the
required 200 foot setbacks in at least two directions.
