This decision is effective <br /> unless appealed· ' <br /> <br />FINDIngS A~D CO~CLUSIO~: The findings and conclusions on which <br />the Director based has decision are noted below. <br /> <br />The subject property is designated Primary Agriculture in <br />the Marion County Comprehensive Plan and is zoned EFU <br />(EXCLUSIVE FARM USE). The primary intent of the Comprehen- <br />sive Plan and zone designation is to promote the continua- <br />tion of commercial farm operations. <br /> <br />The subject property is located on the north side of Mix <br />Road approximately 600 feet east of its intersection with <br />Porter Road. <br /> <br />The subject parcel is surrounded on all sides by land which <br />is in farm use and zoned EFU. The predominate crops in the <br />vicinity are row crops and mint production. There are no <br />other dwellings clustered in the immediate vicinity of the <br />subject residence. <br /> <br />The applicants have requested to place a hardship mobile <br />home, which will become a permanent dwelling, that will be <br />within the required 200 foot setbacks from the property <br />lines. The placement of a non-farm dwelling is subject to <br />the requirements of 136.050. This section requires a <br />special dwelling setback of 200 feet from any abutting <br />parcel in farm use, unless the applicant is granted an <br />adjustment. The adjustment may be granted if it is deter- <br />mined that a lesser setback will prevent activities associ- <br />ated with the dwelling from seriously interfering with <br />farming on adjacent parcels. <br /> <br />The subject property was approved for the placement of a <br />temporary mobile home for medical hardship purposes on 12- <br />28-95 (CU95-76). The approved location of the hardship <br />mobile home was 20 feet from the north property line, <br />approximately 200 feet from the south, approximately 100 <br />feet from the west, and over 200 feet from the east. The <br />existing dwelling is a 1973 Biltmore Deluxe mobile home and <br />is currently located in the southern portion of the parcel <br />approximately 50 feet from the Mix Road right-of-way. <br />Because of the small size of the subject parcel, any dwell- <br />ing located on the property must be located within the <br />required 200 foot setbacks in at least two directions. <br /> <br /> <br />
