This <br />decision is effect.ive~'~,~~k'/~'~'~ unless <br />further consideration l~equested. - - <br /> <br />FINDINGS AND ~ONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The subject 5.0 acres is designated Rural Residential in the <br />Marion County Comprehensive Plan. The purpose of this <br />designation and the corresponding AR (ACREAGE RESIDENTIAL) <br />zone is to allow for the creation of acreage homesites at a <br />density that maintains the character and environmental quality <br />of the County's rural residential areas. <br /> <br />The property is located on the south side of Ditter Drive, <br />approximately 1,200 feet east of its intersection with Sherman <br />Road. <br /> <br />Ail surrounding properties, most of which contain dwellings, <br />are zoned AR. <br /> <br />The applicant proposes to divide the 5.0 acre parcel into two <br />parcels containing 1.5 acres and 3.5 acres each. An existing <br />residence will be situated on the resulting 3.5 acre parcel. <br /> <br />The Marion County Surveyor has reviewed the applicant's <br />request and has the following requirements: <br /> <br />"Parcels 10 acres (and less) must be surveyed. <br /> <br />"Per ORS 92.050, plat must be submitted for review. <br /> <br />"Checking fee, second mylar fee, and recording fee <br />required. <br /> <br />"Plant service report and/or title report must be <br />submitted at the time of review." <br /> <br />The Marion County Building Inspection Division offered the <br />following comments regarding the proposed partitioning: <br /> <br />"An Existing System Evaluation is required on all <br />currently developed parcels to insure there is no <br />conflict between the proposed lot lines and the existing <br />septic systems, including septic replacement areas. <br /> <br />A Site Evaluation approval is required on all parcels <br />that are proposed for development." <br /> <br />The Oregon Water Resources Department indicated "the proposed <br />development is in a Groundwater Limited area, only exempt uses <br />are allowed.
