The applicant is advised that a Partition Plant Service <br />Report, prepared by a title company, will be required upon <br />submission of the final mylar to the County Surveyor. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the <br />following conditions must be continually satisfied: <br /> <br />After the final Partitioning plat has been recorded no alter- <br />ation of property lines shall be permitted without first <br />obtaining approval from the Planning Director. <br /> <br />OTHER PERMITS, FEES, AND RESTRICTIONS: This approval does not <br />remove or affect any covenants or restrictions imposed on the <br />subject property by deed or other instrument. The proposed use may <br />require permits and/or fees from other local, State or Federal <br />agencies. This decision does not take the place of, or relieve the <br />responsibility for obtaining other permits or satisfying any <br />restrictions or conditions thereon. It is recommended that the <br />agencies mentioned in Finding #5 below be contacted to identify <br />restrictions or necessary permits. The applicant is advised of the <br />following: <br /> <br />w <br /> <br />The applicant should contact the Aumsville Fire Department to <br />obtain a copy of the District's Recommended Building Access <br />and Premise Identification requirements. For personal and <br />property safety it is recommended that the applicant follow <br />these guidelines. Fire District access standards may be more <br />restrictive than County standards. <br /> <br />All or a portion of this property has been identified as being <br />located in a "Groundwater Limited Area" as defined by the <br />Oregon State Water Resources Department. The applicant is <br />advised to contact Water Resources (378-3739) regarding <br />possible restrictions or limitations on use of groundwater in <br />the area. <br /> <br />PROCEDURE: The Marion County Subdivision and Partitioning <br />Ordinance provides that certain Partition applications be con- <br />sidered first by the County Planning Director. If there is any <br />doubt that the application conforms with adopted land use policies <br />and regulations the Director must condition or deny the applicat- <br />ion. Any interested person who disagrees with the Director's <br />decision may request that the application be considered by the <br />Marion County Hearings Officer after a public hearing. The <br />applicant may also request a reconsideration (one time only & a <br />$150 fee) on the basis of new information subject to signing an <br />extension of the 120 day time limit for review of zoning applica- <br />tions. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $150.00 fee. Requests for reconsideration, or consideration by <br />the Hearings Officer, must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 285 Church Street NE, Room 160, Salem by 4:30 <br /> <br /> <br />
