(f)

In the case of replacement, the replaced dwelling is
removed, demolished or converted to an allowable non-
residential use within three months of occupancy of the
replacement dwelling.

6 o

A review of building permit records, available tax assessor
records and aerial photographs faile~ to reveal when the home
was originally placed on the property. As part of the written
statement, the applicant's supplied signed statements from
persons who have lived in the area from 7 to 53 years. The
statements indicate that the home was built over 40 years ago,
prior to the area being zoned. Based on available informa-
tion, it is determined that the home was legally placed on the
subject property. Therefore, the criterion in 5(a) is
satisfied.

o

Since the home has been removed from the property it is not
possible to visually verify it contained the items listed in
number 5 above. Marion County Building Inspection records,
together with a statement from a septic system installer,
indicate that there was a septic system on the property. A
signed statement from Oscar Newton indicates that he removed
wiring, water pipes, and a metal roof from the house in
January, 1998. In addition, several area residents indicate
that the home was periodically rented that the dwelling
contained a kitchen, bathroom, and separate shower area.
Based on available evidence it is concluded that the dwelling
contained the items listed in 5 (b), (c), (d), and (e) prior
to its destruction.

Based on the above discussion, Planning Division staff
concludes the existing dwelling was legally established and
may be replaced.

Craig O.
