(f) <br /> <br />In the case of replacement, the replaced dwelling is <br />removed, demolished or converted to an allowable non- <br />residential use within three months of occupancy of the <br />replacement dwelling. <br /> <br />6 o <br /> <br />A review of building permit records, available tax assessor <br />records and aerial photographs faile~ to reveal when the home <br />was originally placed on the property. As part of the written <br />statement, the applicant's supplied signed statements from <br />persons who have lived in the area from 7 to 53 years. The <br />statements indicate that the home was built over 40 years ago, <br />prior to the area being zoned. Based on available informa- <br />tion, it is determined that the home was legally placed on the <br />subject property. Therefore, the criterion in 5(a) is <br />satisfied. <br /> <br />o <br /> <br />Since the home has been removed from the property it is not <br />possible to visually verify it contained the items listed in <br />number 5 above. Marion County Building Inspection records, <br />together with a statement from a septic system installer, <br />indicate that there was a septic system on the property. A <br />signed statement from Oscar Newton indicates that he removed <br />wiring, water pipes, and a metal roof from the house in <br />January, 1998. In addition, several area residents indicate <br />that the home was periodically rented that the dwelling <br />contained a kitchen, bathroom, and separate shower area. <br />Based on available evidence it is concluded that the dwelling <br />contained the items listed in 5 (b), (c), (d), and (e) prior <br />to its destruction. <br /> <br />Based on the above discussion, Planning Division staff <br />concludes the existing dwelling was legally established and <br />may be replaced. <br /> <br />Craig O.
