A public hearing is held on appeals subject to the appellant paying <br />a $150.00 fee. Appeals must be in writing (Appeal' Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 3150 Lancaster Dr. NE, Salem by 4:30 p.m. on <br /> APRIL 20, 1998. If you have any question about this applica- <br />tion or the decision please call 588-5038 or visit the County <br />Planning Office at the above address. This decision is effective <br />APRIL 21, 1998 unless appealed. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based has decision are noted below. <br /> <br />The subject property is designated Primary Agriculture in the <br />Marion County Comprehensive Plan and is zoned EFU (EXCLUSIVE <br />FARM USE). <br /> <br />The property is located on the north side of Snoddy Drive SE, <br />approximately 1,500 feet east of its intersection with West <br />Stayton Road SE. The property contains a well and a concrete <br />pad for the proposed homesite. <br /> <br />The entire area is zoned EFU and consists of a mixture of <br />large farmed parcels and smaller parcels which generally <br />contain single family dwellings. <br /> <br />The applicants are proposing to replace an existing dwelling <br />that'was removed from the property on January 1998. <br /> <br />Section 136.030(D) of the Marion County Rural Zoning Ordinance <br />allows the alteration, restoration, or replacement of a <br />dwelling subject.-to certain requirements. These include: <br /> <br />(a) The dwelling was lawfully established; and <br /> <br />(b) Has intact exterior walls and roof structure, and <br /> <br />(c) <br /> <br />Has indoor plumbing consisting of a kitchen sink, toilet <br />and bathing facilities connected to a sanitary waste <br />disposal system; and <br /> <br />(d) Has interior wiring for interior lights; and <br /> <br />(e) Has a heating system; and <br /> <br /> <br />
