o <br /> <br />The applicants are requesting permission to adjust the lot <br />lines on a 5.76 acre parcel and a 5.74 acre parcel to cregte <br />a 3.0 acre parcel and an 8.5 acre parcel. An existing <br />dwelling will be situated on each of the resulting parcels. <br /> <br />The Marion County Surveyor has reviewed the proposal and has <br />the following requirements: <br /> <br /> "The property line adjustment must be surveyed per <br /> ORS 92.060(7) and the survey submitted for review. <br /> <br /> Survey checking fee required at time of review. <br /> <br /> P~operty line adjustment deed shall be recorded <br /> wlt~ the County Clerk. Per ORS 92.190(4): the deed <br /> shall contain the names of the parties, the de- <br /> scription of the adjusted line, references to <br /> origznal recorded documents and signatures of all <br /> parties with proper acknowledgment." <br /> <br />The Marion County Department of Public Works has reviewed the <br />applicants' request and has the following comments: <br /> <br /> "Silver Falls Drive is classified a rural major <br /> collector route in Marion County's draft Transpor- <br /> tation System Plan. The r~ght-of-way width stan- <br /> dard for a rural collector is 60 feet. The appli- <br /> cants shall dedicate sufficient right-of-way to <br /> provide a 30-foot right-of-way half width along <br /> t~eir Silver Falls Drive frontage. It appears that <br /> five feet of additional width is required. Any <br /> dedications should be to the public, not to Marion <br /> County. <br /> <br /> Driveway permits will be required for any new <br /> access or change in existing access to the public <br /> right-of-way. (Oregon Department of Transportation <br /> has jurisdiction over Silver Falls Drive.) Also, <br /> any utility work in the public right-of-way will <br /> require a utility permit from the appropriate <br /> agency." <br /> <br />The Marion County Building Inspection Division has the <br />following comments on the proposed lot line and commented: <br /> <br /> "An Existing System Evaluation is required on all <br /> currently developed parcels to insure there is no <br /> conflict between the proposed lot lines and the <br /> existing septic systems, including septic replace- <br /> ment areas. <br /> <br />A Site Evaluation approval is required on all <br />parcels that are proposed for development." <br /> <br />Marion County Comprehensive Plan policies for rural residen- <br />tial areas, provide that homesites should be 1.5 acres to 3.0 <br />acres in size. In addition, the AR-3 zone contains a minimum <br />lot size of 3.0 acres. Both resulting parcels exceed these <br />requirements and the large parcel, by meeting requirements of <br />the SGO-A zone, is of sufficient dimension to allow partition- <br />ing. In addition, both parcels are of sufficient size to <br />comply with the Ordinance development standards. <br /> <br /> <br />
