o

The applicants are requesting permission to adjust the lot
lines on a 5.76 acre parcel and a 5.74 acre parcel to cregte
a 3.0 acre parcel and an 8.5 acre parcel. An existing
dwelling will be situated on each of the resulting parcels.

The Marion County Surveyor has reviewed the proposal and has
the following requirements:

"The property line adjustment must be surveyed per
ORS 92.060(7) and the survey submitted for review.

Survey checking fee required at time of review.

P~operty line adjustment deed shall be recorded
wlt~ the County Clerk. Per ORS 92.190(4): the deed
shall contain the names of the parties, the de-
scription of the adjusted line, references to
origznal recorded documents and signatures of all
parties with proper acknowledgment."

The Marion County Department of Public Works has reviewed the
applicants' request and has the following comments:

"Silver Falls Drive is classified a rural major
collector route in Marion County's draft Transpor-
tation System Plan. The r~ght-of-way width stan-
dard for a rural collector is 60 feet. The appli-
cants shall dedicate sufficient right-of-way to
provide a 30-foot right-of-way half width along
t~eir Silver Falls Drive frontage. It appears that
five feet of additional width is required. Any
dedications should be to the public, not to Marion
County.

Driveway permits will be required for any new
access or change in existing access to the public
right-of-way. (Oregon Department of Transportation
has jurisdiction over Silver Falls Drive.) Also,
any utility work in the public right-of-way will
require a utility permit from the appropriate
agency."

The Marion County Building Inspection Division has the
following comments on the proposed lot line and commented:

"An Existing System Evaluation is required on all
currently developed parcels to insure there is no
conflict between the proposed lot lines and the
existing septic systems, including septic replace-
ment areas.

A Site Evaluation approval is required on all
parcels that are proposed for development."

Marion County Comprehensive Plan policies for rural residen-
tial areas, provide that homesites should be 1.5 acres to 3.0
acres in size. In addition, the AR-3 zone contains a minimum
lot size of 3.0 acres. Both resulting parcels exceed these
requirements and the large parcel, by meeting requirements of
the SGO-A zone, is of sufficient dimension to allow partition-
ing. In addition, both parcels are of sufficient size to
comply with the Ordinance development standards.
