damage potential and are anchored or are readily removable <br />from the area within the time available after forecasting and <br />warning. <br /> <br />OTHER PERMITS, FEES, AND RESTRICTIONS: This approval does not <br />remove or affect any covenants or restrictions imposed on the <br />subject property by deed or other instrument. The proposed use may <br />require permits and/or fees from other local,' State or Federal <br />agencies. This decision does not take the place of, or relieve the <br />responsibility for obtaining other permits or satisfying any <br />restrictions or conditions thereon. <br /> <br />PROCEDURE: The Marion County Zoning Ordinance provides that <br />Floodplain Development applications be considered first by the <br />County Planning Directorl If there is any doubt that the applica- <br />tion conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested <br />person who disagrees with the Director's decision may request that <br />the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a reconsid- <br />eration (one time only and a $200 fee) on the basis of new <br />information subject to signing an extension of the 150 day time <br />limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $250.00 fee. Requests for reconsideration, or consideration by <br />the Hearings Officer, must be in writing and be received in the <br />Marion County Planning Division, 3150 Lancaster Dr. NE, Salem, by <br />4:30 p.m. on FEBRUARY 22, 1999. This <br />decision is effective FEBRUARY 23, 1999 unless further consider- <br />ation is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The subject property is designated Primary Agriculture in the <br />Marion County Comprehensive Plan. The intent of this designa- <br />tion and corresponding EFU (EXCLUSIVE FARM USE) zone is to <br />promote the continuation of commercial agriculture. A portion <br />of the property is also situated within the Urban Growth <br />Boundary of Aurora and is designated Low Density Residential <br />in the Aurora Comprehensive Plan. The purpose of this <br />designation and the corresponding UTF (URBAN TRANSITION FARM) <br />zone is to encourage the continued practice of commercial <br />agriculture in areas planned for future urban residential <br />development. The property is also designated by Marion County <br />as being located within the identified 100 year floodplain of <br />the Pudding River. <br /> <br /> <br />
