16. <br /> <br />A ta~k installation permit is required from Fargo Interchange <br />Sewer District before installation of a tank and pump assem- <br />bly. <br /> <br />17. <br /> <br />Any utility work in the Ehlen Road right-of-way will require <br />a utility permit from Public Works. <br /> <br />PROCEDIFRE: The Marion County Zoning Ordinance provides that <br />certain Conditional Use applications be considered first by the <br />County Planning Director. If there is any doubt that the applicat- <br />ion conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested <br />person who disagrees with the Director's decision may request that <br />the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a recon- <br />sideration (one time only & a $150 fee) on the basis of new <br />information subject to signing an extension of the 150 day time <br />limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $150.00 fee. Requests for reconsideration, or consideration by <br />the Hearings Officer, must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 3150 Lancaster Drive NE, Suite B, Salem by 4:30 <br />p.m. on APRI~ 30, 1998. If you have any question about this <br />application or the decision please call 588-5038 or visit the <br />County Planning Office at the above address. This decision is <br />effective~W. AY 1, 1998 unless further consideration is requested. <br /> <br />FI~-DINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The northern portion of the subject 31+ acres is designated <br />Interchange Development in the Marion County Comprehensive <br />Plan, and is correspondingly zoned ID (INTERCHANGE DISTRICT). <br />The applicants are proposing to develop the western part of <br />this area. The remainder of property to the south is zoned <br />EFU (EXCLUSIVE FDJRM USE). The entire acreage is located <br />within the Airport Overlay Zone for the Aurora Airport. <br /> <br />The property is located approximately 1,600 feet west of the <br />Interstate 5/Fargo Road interchange. <br /> <br />3 o <br /> <br />Situated between the subject property and Interstate 5 to the <br />west is a truck stop/automobile service station. The subject <br />property is a horseshoe shaped parcel with a mixture of <br />commercial and light industrial are located in the center. To <br />the northeast across Ehlen Road is a truck stop, restaurant <br />and an undeveloped parcel. These areas are all zoned ID. <br />Land to the south and northwest is zoned EFU and is in <br />agricultural production. <br /> <br /> <br />
