7. RIGHT OF ENTRY: ENCROACHMENTS: EASEMENTS FOR MAINTENANCE. <br />(a) In case of any emergency originating in or threatening its unit, a unit owner shall grant <br />the right of entry to the management agent or to any other person authorized by the Boazd of Directors or <br />the Association, whether the unit owner is present at the time or not. <br />(b) An easement is reserved to the Association in and through any office unit and the <br />common elements providing access at reasonable times and. with reasonable notice for ~ purposes of <br />maintenance, repair and replacement of the common elements. if, in the process of such repair and <br />maintenance by the Association, it is nocessary to alter or damage any office unit or common elements, <br />such alterations or damages will be permitted without compensation, provided the uait and/or common <br />elements are prompdy restored to substantially their prior condition by the Association. <br />(c) If any portion of the common elements encroaches upon a unit, or a unit encroaches <br />upon any portion of the commoa ele~nts. a valid easement for the encroachment and for the maintenance <br />of the same, so long as it st~nds, shall be and does exis~ In the event the s~tucWres are partially or totally ~ <br />destroy~ and then rebuilt, the owners of the units agree that minor encroachment of parts of the common <br />elements due to such rebuilding shall be allowed and an easement shall eust for such purpose. <br />ARTICLE VII - <br />USE AND OCCUPANCY RESTRICTION: RULES OF CONDUCT <br />~ Failure by a unit owner (its employees, guests, invitees or lessees) to comply with the rules of conduct <br />and restrictions set forth hereinafter or others pmmulgated by the Board of Directors shall be cause for <br />which the Boazd of Directors may deny or restrict such unit owner's right to use any common element <br />facility with respect to wlrich such unit owner otherwise had a right of use. <br />1. GOVERNMENfAL OFFICE USE. Each of the office. nnits will be occupied as offices for <br />governmental agencies or by leasees of the unit owners and for their visitrns and guests, and, in addition, <br />with respect to Units owne~i by the Salem Area Mass Transit District, passenger waiting rooms, ticket sales <br />office, break room and other transit related uses. and for no other putpose. All common elements shall be <br />used in a manner that dces not conflict with such purpose. . <br />~ 2. RESTRICTION ON ALTERATION TO UrTIT. No unit owner shall make modifications or <br />alterations in its office unit, or installations located therein, affecting the structural or bearing components <br />of the building without previously notifying the Association in writing, through the management agent, if <br />any, or through the Chair of the Board of Dinectors, if no management agent is employed. The Association <br />shall have the obligation to answer within t6iriy (30) days, and failure to do so within the stipnlated time <br />~• .shall mean that t6ere is no objection to the pmposed modification or alteration. Provided, however, nothing <br />herein contained shall waive or limit a unit owner's obligation to comply with the provisions of ORS <br />100.535. <br />3. USE OF THE COMMON ELEMIIV'TS . No unit owner shall place or cause to be placed in the <br />lobbies, stairways, elevators and other common elements of the Condominium any furniture, packages or <br />objects of any kind without the prior written consent of the Board of Directors. Such areas shall be used <br />for no purpose other than what is normal and customary. <br />4. APPEARANCE OF OFFICE BUII.DING. No unit owner will cause anything to be hung, <br />displayed, or placed on the walls, doors, windows, walkways, ceilings of walkways or roof of . the office <br />building or any other common element nor otherwise change the appearance of any portion of the <br />common elements without the prior written consent of the Boazd of Directors: The Transit District may <br />place displays or decorations on that portion of the office building exterior north facing wall, on the first <br />floor level facing the Transit Mall Unit. <br />~ ! .
