Yesterday we had a lonq staff ineeting with Pence/Kelly and Century West on <br />the environmental issues on the site. We are in the process of educating the <br />contractor on all the research and outcomes that has occured on the site over <br />the past couple of years. The contractor, starting this next week, will start <br />staging on the site and the first thing to happen will be a portable rock <br />crusher will be set up. The contractor will recycle the existing site material <br />(that that is deemed "clean") and use it as back fill on site. Excavation and <br />"dewatering" will begin on the old Chevron portion of the block (S.E. corner). <br />It appears that they will stage the job shacks on the High St. parking area <br />(on street) and they will establish two mid block entrances/exits on the block <br />( High and Chemeketa St). During excavation Century West will have a staff <br />person on-site 100~ of the construction hours to monitor and advise the <br />contractor on disposal method to be used. The contractor understands the <br />requirements and has alternate plans and/or contractor for "hot spots". <br />2. John and I met with Arbuckle Costic this a.m. and gave them a face to face <br />answer on their contract concerns. We expressed empathy for their situation <br />but told them that there was nothing we could do at this time. <br />3. John and I received both our legal counsels review of Pence/Kelly requested <br />changes to the contract and we met with Curt Pence and Dave Hayes and went <br />over those. Essentially no change in the contract except we will develop a <br />separate side letter on the lien provisions that they proposed (no <br />substantive modifications to the drafted agreement). <br />Curt Pence, John Whittington and I executed the agreement at the meeting. <br />4. I will be out of state on personal business most of next week so there will <br />not be any updates on the management staff agendas from me. <br />Things are going well, thanks. <br />CC: jdavis, dhartwig, rcurtis, mhansen <br />
