On February 12, 1999, the project coordinator was notified in writing of the Agency <br />analysis and acceptable level of participation consistent with the terms of the <br />Agreement. The notice clearly indicated that the maximum participation for the <br />elements bid was $1,067,096, or $247,883 less than the amount bid by Pence/Kelly <br />Construction. <br />On February 17, 1999, after receiving notice of acceptable levels of Agency <br />participation, the County and Transit District awarded the construction contract to <br />Pence/Kelly Construction. After having awarded the construction contract, the <br />Intergovernmental Participation Agreement was executed by the Transit District and <br />the County on February 17 and 18, 1999, respectively. <br />On March 29, 1999, the Transit District and Marion County filed a letter with City <br />Council requesting the Agency participation be increased by the $247,883. The <br />request was referred to staff for analysis. On May 3, 1999, Council received the <br />staff analysis recommending the request be denied (Exhibit II). Council carried the <br />item forward to subsequent agendas and has taken no action on the request. <br />Several joint meetings were held by Council with the County and Transit Boards. In <br />)une 1999, details of the difFerences in bid cost were discussed (Exhibit III). No <br />consensus was reached on the requested funding increase. <br />Development of the Courthouse Square project has proceeded under the terms and <br />conditions of the agreement as originally executed between the Agency, County and <br />Transit District. <br />As of June 20, 2000, a total of $1,373,819, including approved change orders, has <br />been accepted for funding participation within the $2,000,000 maximum of the <br />agreement as follows: <br />A.
