CONDOMINIUM DECLARATION FOR COURTHOUSE SQUARE CONDO~UM This Declaration submits to [he provisions, restrictions and limitations of tlie Oregon Condominium Act land hereinafter described, and all improvements now ezisting or to be constructed on such property, to be lmown as the COURTHOUSE SQUARE CONDOT~IIIVICTM. ' Marion County, Oregon, a municipal corporation and political subd.ivision of the State of pregon, and the Salem Area Mass TY~ansit Districi, a municipal corporation and political subdivision of thc State of Oregon, (joinfly. "Declarant"), are the owners as tenants in common of the real property described hereinbelow and desire to submit said property to the condominium focm of ownership, to be •converted, handled and.used in the manner provided by the Oregon Condominium Act. NOW, THEREFORE, - DECLARATION Declarant hereby declares on behalf of themselves, their successors, grantees and assigns, as well as to any and all persons having, acquiring ar seeking to have or acquire any interest of any nature whatscever in and to any part of the property, as follows: 1. DEFINITIONS. Ezcept as otherwise provided or modified by this Section, the terms herein shall have the mP~ning set forth in the Oregon Condominium Act, ORS 100.005 ~~q,., and said statute and definitions are incorporated herein by this refea~eace. As used in this De~laradon and in the Bylaws, t~e following terms shall have the following meanings: "Condominium" means the land, all buildings, improvements and structures thereon, and all easements, rights and appurtenances belonging thereto, which are herewith submitted to the provisions of the Oregon Condominium Act. "Office Unit" means, when used in reference to units within the office building, the airspace encompassed by the undecorated interior surface of the peri.meter walls, floors and ceilings which is owned in fee simple by each Unit owner and which is more specif cally described in Soction 3.2 of this Declaration. Other capitalized terms refecring to Units are defined or described in the plat filed herewith. 2. LAND DESCRIP'ITON. The interest being submitted to the Oregon Condominium Act is the Declarants' fee simple interest in thaz certain parc~l of more particularly described as follows: Block S, SALF.M, Marion County, Oregon SAVE and EXCEPTING therefrom the following described property: See Ezhibit A.
