3.1 Name. The name by which the property submitted hereunder shall be lrnown is the
<br />COURTHOUSE SQUARE CONDOMINIUM•
<br />3.2 Boundaries of Units. (a) The Parking Units shall be those parking spaces located as
<br />depicted on the plat and shall have the boundaries and designations depicted on the plat~
<br />_(b) The Mall Unit shall be bounded by the vertical planes eztending upwards at the perimeter as
<br />depicted on the plat and shall be bounded by horizontal plane tangential to the upper surface of the
<br />parking garage slab as depicted on the plat
<br />(c) The Hearing Room Unit shall be bounded by the interior surfaces of the studs in its
<br />perimeter walls, the unfinished floors, and ceilings. The Hearing Room Unit shall include all lath,
<br />fumng, wallboard, plasterboard, plaster, paneling~ tiles, wallpaper, paint, finished flooring, ceiling tiles or
<br />matenal and any other materials constitut~ng any parc of its finished surfaces and the ezterior surfaces so
<br />described.
<br />(d) The Office Units shall be bounded by the interior surfaces of the studs in its perimeter walls,
<br />the unfinished floors. and ceilings. The Office Units shall include all lath, fumng, wallboard,
<br />plasterboazd, Plaster, paneling, tiles, wallpaper. Paint, finished flooring, ceiling tiles or material and any
<br />other materials constituting any part of its finished surfaces and the eaterior surfaces so described. All
<br />other portions of the walls, floors or ceilings shall be a part of the common elements, including, without
<br />limitation, windows and window frames.
<br />(e) In addition, the Hearing Room Unit and each Office Unit shall include the following:
<br />(i) All spaoes, interior partitions, trim, eacterior doors, door frames, and all other fixtures
<br />and improvements within the boundaries of the Unit, including without limitation, structures or
<br />materials lying within a Unit which support the building .or any portion thereof, except as
<br />provided in Section 4.1(b) below; and .
<br />(u) All ouflets of utility service lines, including, but not limited to, power, electronic
<br />data, telephone, light, gas, hot and cold water~ heating, refrigeration, air conditioning and waste
<br />disposal within the boundaries of the Unit, but shall not include any part of such lines or ducts
<br />themselves.
<br />In interpreting deeds, deeds of trust and other instruments for any purpose whatsoever or in
<br />connection with any mauer, the ~cacisting physical boundaries of the Unit, or of a Unit reconstructed in
<br />substantial accordance with the original plans hereof. shall be conclusively presumed to be the
<br />boundaries, ~gardless af settling, rising or lateral movement of the building or other unprovements, and
<br />regardless of variances between boundaries as depicted on the plat and those of the actual building or
<br />other improvements.
<br />3,3 Buildin~ DcscriDrion ~nd Unit DesiQnadon. The land submit~ed by this Declaration has
<br />one (1) building thereon in which the Hearing Room Unrt and the Office Units are located, an improved
<br />parking garage located below grade in which the Par3dng Units are located, and an area improved for
<br />use as a bus mall in which the Mall Unit is located. The building, which is five (5) stories with a
<br />basement parking structure, is constcucted of steol, reinforced concret~ and brick The roof is
<br />constructed of a rubberized membrane with a rock ballas~ The condominium contains one Hearing
<br />Room Unit, two Office Units, one Mall Unit, and two Parking Units (designated GP and TP, respectively).
