Randy Franke
December 29, 1997
Page 2
While there is not fixed date of termination, it is detemiinable by development
of adequate construction documents and the ability to develop a GMP. The owner,
Marion County and the Transit District, retain the right to terminate the agreement
at any time, however. Temunation is accomplished by written notice to the
contractor. In the event the contract is terminated, payment for all services rendered
by the contractor up to the effective date of the termination must be paid.
There are, then, several considerations that the County and the Transit District
should take into account with this interim agreement:
1. Should the owners authorize or a11ow services beyond December 31, 1997?
If the owners so allow or authorize, such services would be compensable at
the hourly rates set forth in the agreement.
2. Should the owners continue with this agreement until such time as a GMP can
be developed and negotiated?
MJH:at
_ , ~__., -:: ...
~.:c: Bxlly Wasson; = Courthouse~quare ;Eroject;~~oordinator ~; ~
courthous\gmp.mem
