Chapter 4: Methods of Selection <br />http://www.fta.dot.gov/fta!library/admiaBPPman/sect 40.htm <br />• If determined necessary, an opportunity is provided (through a pre-bid or pre-proposal conference) <br />for prospective offerors to meet with procuring agency officials to get answers to questions prior <br />to the submission of the bids or initial proposals. <br />• A reasonable amount of time is provided prospective offerors in which to prepare and submit their <br />offers. <br />• Rules are normally provided that specify treatment of offers that are submitted late. <br />• Award will only be made to an offeror determined to be "responsible." <br />Differences between the Methods of Procurement - The competitive proposal procurement method <br />differs from the sealed bidding process in that: <br />• A complete, adequate and realistic specificationor purchase description allowing for competition <br />primarily on the basis of price alone may not be available. <br />• The contract awa.rd amount, whether a firm-fixed price or some type of cost reimbursement <br />contract, can only be deternuned on the basis of costs of the contractor derived from a negotiation <br />process. <br />• Discussions or negotiations may be needed to address technical requirements as well as proposed <br />cost or price aspects of the offeror's proposal. Discussions may be conducted with one or more <br />offerors who have submitted prapasals. <br />• An opportunity may be given to revise proposals and to submit a final proposal at the completion <br />of the discussion phase of the process. <br />4.3.2 Common Elements of Solicitation Process <br />4.3.2.1 Advertising and Publicizing $olicitation <br />UIREMENT <br />§ 8. a of FTA Circular 4220.1 D requires that all procurement transactions be conducted in a manner <br />providing full and open competition. <br />~§ 9.c. of FTA Circular 4220.1D requu'es that invitations for bids are to be "publicly" advertised. <br />~§ 9.d of FTA Circular 4220.1D requires that requests for proposals are to be publicized. <br />State law requirements are sometimes more specific as to the content and manner of advertising, <br />particularly when using the sealed biddin,~method. <br />DISCUSSION <br />IFBs and RFPs must be pubiicly ad~-ertised and publicized (respectively)_but the precise manner <br />and content is at your discretion withifl your state law requirements.
