4. Construction Contract Chanqe Order <br />Should the need arise for issuance of a contract change order for any item of <br />Agency participation such change order shall be submitted to the Agency for its <br />approval, rejection or modification prior to issuance. The Agency shall designate its <br />approval, rejection or requested modification of the submitted change order in writing <br />within five (5) days of submission. Any additional cost associated with a change order <br />affecting items of Agency participation which is issued without the prior approval of the <br />Agency will be at the sole expense of the County and Transit District. <br />5. Construction Contract Change Order Caused by Plan Check -Permit <br />Issuance <br />It is anticipated that the plan check and associated permit issuance by the City of <br />Salem for the Project may be completed after construction contract bid award by the <br />County and Transit District. Through the plan check process modifications to the plans <br />and/or specifications may be required. Elements of such change in the Project plans <br />and/or specifications will not have been subject to the public bid process and may <br />cause the need for issuance of a contract change order. Under said circumstance <br />Agency reserves the right to determine the maximum amount of Agency's financial <br />participation. Should the need arise for issuance of a contract change order for any item <br />of Agency participation due to a modification of the plans and/or specifications as a <br />result of the plan check for issuance of applicable permit(s) such change order shall be <br />submitted to the Agency for its approval, rejection, modification or designation of <br />maximum amount of financial participation prior to issuance. The Agency shall <br />designate its approval, rejection, modification or designate an amount of maximum <br />participation for the submitted change order in writing within five (5) days of submission. <br />Any additional cost associated with a change order affecting items of Agency <br />participation which is issued without the prior approval of the Agency will be at the sole <br />expense of the County and Transit District. <br />6. Architectural/Enaineering Fees <br />a. The Agency shall pay to the County and Transit District an amount <br />not to exceed six percent (6%) of the actual cost of construction, accepted for payment <br />by the Agency to the County and Transit District for items of participation, as a <br />reimbursement for architectural/engineering fees, subject to the limitations contained in <br />Section 6 d. <br />b. Payment request for architectural/engineering fees shall be <br />submitted to the Agency as progress payments. Each payment request submitted <br />under Section 6 shall include an amount for such fees not to exceed six percent (6%) of <br />the completed construction work for which a reimbursement payment is requested. <br />Architectural/engineering fees will be paid by the Agency within thirty (30) days of <br />~, submission of the payment request. <br />4 <br />
