licensed architect/engineer for the specific areas of Agency participation designated in <br />~,,, Section 1. The plans and specifications shall be submitted by the County and Transit <br />District to the Agency for review and approval in the same form as the plans and <br />specifications are submitted to the City of Salem for a building permit. Acceptance, <br />rejection or request for modification of the plans and specifications will be provided in <br />writing by the Agency within fifteen days (15) of submission to the Agency. Should the <br />plans and specifications be rejected or modifications requested, the Agency will accept <br />for review revised plans and specifications and provide its written notice of acceptance, <br />rejection or request for modification within fifteen (15) days of a re-submission. <br />b. Agency acceptance of the plans and specifications for the items of <br />participation shall constitute approval for financial participation as set forth in this <br />Agreement and shall not constitute or imply compliance with City of Salem Department <br />of Public Works Standards for Design and Construction of Public Improvements nor <br />shall Agency approval constitute or imply building permit issuance by the City of Salem. <br />3. Public Bid - Bid Form - Agency Bid Acceptance <br />a. All items subject to Agency participation shall be publicly bid for <br />construction contract award in conformance with public improvement bidding <br />requirements of the applicable State and Federal law. <br />~ b. The bid form shall require line item bid cost with unit price as <br />applicable for each item of Agency participation. The bid form, for items of Agency <br />participation, shall be submitted to the Agency for approval prior to bidding and may <br />provide for additive or deductive bid alternates. The Agency shall approve, reject or <br />request modification of the bid form in writing within five (5) days of submission. Should <br />the bid form be rejected or modifications requested, the Agency will accept for review <br />revised bid form and provide its written notice of acceptance, rejection or request for <br />modification within five (5) days of re-submission. <br />c Prior to construction contract bid award for the items of Agency <br />participation, the low bid recommended for award by the County and Transit District <br />shall be submitted to the Agency. The Agency will designate in writing within five (5) <br />days of submission, acceptance, rejection or designation of bid alternate for which the <br />Agency will provide participation. Agency approval for participation will not be <br />unreasonably withheld, however, reasons for withholding of such approval shall include <br />but not be limited to bid irregularity or unreasonable unit cost. Agency acknowledges <br />that the low bidder for the entire Project construction may not necessarily represent the <br />lowest bid tendered for each of the specific areas of Agency participation designated in <br />Section 1, however, in the event the Agency finds unit cost to be unreasonable, Agency <br />may designate an acceptable level of participation for the respective item. <br />~ <br />
