As the project managers, we feel that this action is a necessary and appropriate <br />response to the use of the foreign rebar in the Courthouse Square project. <br />Certainly upon reviewing the Buy America regulations, there is no other <br />course of action which would come to mind. You should be aware also that <br />the Federal Transit Administration will examine this instance, and could <br />consider sanctions which are beyond the scope and responsibility of the <br />District and County. <br />Again, we appreciate the fact that there was no apparent desire to ignore the <br />Buy America regulations. However, the delivery and use of foreign steel <br />violated the contract and the applicable Federal regulations. As the project <br />owners, we aze satisfied that the error was unintentional, and it is regrettable <br />that the resolution of the matter involves a financial impact upon the <br />contracting team.
