OR 97309 <br />Bus.(5031371-3013 <br />Fax(503)364-1453 <br />EMPLOYMENT AGREEMENT <br />Marion Countv, hereinafter refened to as "Client", hereby employs Dan Berrey of The Prudential Rea1 Estate <br />Professionals, hereinafter refened to as "Agent", as Client's exclusive a~ent to obtain for Client an acceptable <br />property to lease under the following conditions: <br />l. This Exclusive Right to Lease shall begin as of Nnve.mher l, 1996, and terminate at midnight on ~h <br />~2;~ ~~1~199~. i <br />2. General requirements of the transaction and property to be obtained are: To locate, analyze, negotiate, <br />an acceptable lease arrangement. <br />3. Client, upon the closin~ of the escrow of the transaction, will pay to A~ent the sum of 4° as an earned <br />fee, unless Agent can successfully negotiate payment of an equal or greater fee by seller. This fee will be <br />based on the total Gross Rent to be paid over the life of the original lease. <br />NOTICE: TI-~ AMOL`NT OR RATE OF REAL ESTATE COMNIISSIONS IS NOT FIXED BY LAW. <br />'I'HEY ARE SET BY EACH BROKER INDNIDliALLY AND NIAY BE NEGOTIABLE BETWEEN THE <br />CLIENT AND BROKER. <br />4. This is an Exclusive Right to Lease for the purpose stated during the term hereof, and in consideration <br />of this Exclusive Right, Agent will pursue dilige~atly the location of az~ acceptable property, and negotiate for <br />it's lease. Any lease of property by the Client as outlined in Paragraph 2 herein whether located by <br />Agent or not, or disclosed to Client by Agent during this exclusive Right to I.ease and the fee shall be <br />payable whether or not Client or any other persons negotiate the transaction. <br />5. In the event that, during the year following the termination of this Exclusive Right, Client purchases any <br />property disclosed to client by Agent, client will pay the above fee to Agent. <br />6. Client authorizes Agent to originate lease proposals in Client's behalf subject to client's final written <br />approval. <br />7. This Exclusive Right may be canceled by either party hereto upon presenting to the other party a sixty day <br />written notice of intent to cancel.
