The issue separating us <br />from agreement is the figure constituting the price of a <br />comparable replacement dwelling (line 1, infra). We use the <br />following calculation to determine the amount of the rental <br />assistance payment: <br />(line 1) rent of comparable dwelling <br />(line 2) - rent of displacement dwellina <br />total <br />x 42 (months) <br />= rental assistance <br />However, The Uniform Relocation Assistance and Real Property <br />Acquisition Act (42 U.S.C. 4601 et seq.) computes the baseline <br />figure subtracted lline 2) with regard to cost of my current <br />rental or with regard to my income. The federal act states <br />"Computation of a payment under this subsection [sec. 4624(a)] to <br />a low-income displaced person for a comparable replacement <br />dwelling shall take into account such person's income. 42 <br />U.S.C. 4624 (1994). What is subtracted (line 2) in the <br />calculation is the lesser of: <br />1. My current monthly rent plus utilities; or <br />2. 30~ of my monthly income. <br />I have enclosed an estimate of my gross monthly income (see <br />enclosure: "Replacement Housing Worksheet"). My estimation is <br />based on a average monthly income. If this is incorrect because <br />it should be based on yearly salary divided by twelve (increasing <br />the settlement amount because I am recently employed) please <br />inform me and we can make the necessary adjustments. <br />This letter in no way negates the effect of a valid contract <br />between you (per your agent Ms. Andrews) and I. This letter <br />describes another means to reach a settlement. Please inform me <br />of the necessary procedure for documenting my monthly income and <br />when you would like to meet in order to fill out and sign the <br />appropriate documents. <br />It has recently come to my attention that you do not have <br />legal title to the building at 563 Court Street.
