~,..- ""'w <br />Mr. Heinle stated he is a full time student and did not have a signed copy <br />of his income tax return. When asked how could his rent and utility <br />payment exceed his income, he indicated his girlfriend and friends feed <br />him. He bought his own books and supplies. He cashed a$500 bond in <br />January 1997 which is beyond the income year considered in the claim. <br />At that time he said he had no other sources of income during the year. <br />His 1996 income was earned in Corvallis where he lived with four or five <br />other students. He moved to Salem and the Court Street apa.rtment in <br />August 1996. He indicated he did not share the apartment. <br />September 16, 1997 Relocation Claim transfened from Mr. Berrey to Marion County Properry <br />Management. <br />September 24, 1997 Elyn spoke with Mr. Heinle on the telephone (581-0306). He indicated he <br />had received $75.00 a month from Willa.mette on a work study. He did <br />indicate how many months in 1996 he received this income. (It does not <br />appear on his income tax returns.) He also indicated he would be filing an <br />appeal and had talked with an arbitrator lawyer who would take 1/3 of his <br />settlement for payment. He indicated he believed he was entitled to a <br />settlement sunilar to Mr. Samuel Crowell who resided in another Court <br />Street apartment. <br />I was unsuccessful in determining how much and what source of income Mr. Heinle has to pay <br />the difference between what he earned and declared on his income tax returns and what it cost <br />him for rent, utilities, books and supplies. <br />Some of my questions are: Is it appropriate to require a signed copy of income t~ returns? If <br />Mr. Heinle is currently sharing an apartment as the rental agreement indicates, should the rent be <br />considered shared 50/50? It is appropriate to presume Ms. Napp's rent share is $247.50 and Mr. <br />Heinle's rent is also $247.50? <br />Please review this claim and recommend the appropriate settlement that should be offered to Mr. <br />Heinle. Since Mr. Heinle has indicated he was seeking legal counsel, it is appropriate that I brief <br />my legal counsel and request Mr. Heinle to make inquiries through them.
