The undersigned agrees, ff awarded the Corttrad forthe Worfc, to execute and deliver to the Owner not later than the date of exeadion of the CoRtract a satisfactory Pecformance Bond and Labor and Material Payment Bond; each in an amount equal to 100~0 of the total Lump Sum in the /~qreement. Bid Security in an amount not less then ten (10) percent of the total Lump Sum Basic Bid in the Proposal Fonn is enclosed. The undersigned further agrees that the Bid Security, payable to the Owners, Marion Courrty and Salem Area Mass Transit Distrid, shall be lef~ in escrow with the Owner, that if selected by the pwne~ as su~ful bidder, the full amourrt of the Bid Secx~rity as the measure of liquidated damages which the Owner will sustain by faitur~ of the undersigned to execute and deliver the specified Contrad and Performa~ce/Material Payme~t Bo~d within ten (10) days after written notification of such selection shall be forteited and become payable to the Owner if the undersigned defautts by such failure.
