~ <br />ITEM 6: Environmental Update <br />Chevron Clean-up: Our environmental attorney has encountered a cap on the amount that <br />~ Chevron will pay on cleanup. They will only pay $60k. Our estimate is at $350k. The cap is <br />tied to the remediation cost of the site. Our consultants are looking at the justification. Dan said <br />that there is a level of risk. We won't know the level of contamination until we excavate. <br />Chevron may file an injunction to shut us down until the county takes control of the site. This <br />will get them off the hook to a certain level. Kathleen is still optimistic. She has reached Jerry <br />Mitchell with Chevron. His tone has taken on a strong position. She has scheduled a meeting <br />for April 8, 2:00 p.m. to meet with legal counsel and a representative from Chevron. This <br />meeting will be held in California. If Chevron is positioning themselves to take a hard line, we <br />may have to take control of the site. Dan wants everyone to know that we may have an <br />injunction on the project. <br />The Statesman Journal also has the opportunity to file an injunction against our project. They <br />are claiming that contaminants may backup onto their site. They may want to shut down the <br />project until an agreement is met. If we dig first, their contaminants will come our direction. <br />There is a risk if either of us dig first. They may be waiting to coordinate with us. We may find <br />impacted soil from the Texaco site when the Ticor Building comes down. If Chevron files an <br />injunction, it impacts the Statesman also. Dan said that we need to coordinate with the <br />Statesman Journal consultants and their attorney to formulate a mutual agreement to work <br />together sharing info and dewatering the site. The agreement with the Statesman Journal is very <br />one sided. Their concern is that our contaminants are flowing their direction. <br />~; Meeting adjourned. <br />~ <br />
