<br />4.8 The Owner sliall furnish all tegal, accounting and

<br />4.9 The services, information_ su~~e~~s and repoRs

<br />rehr upon the accuracy and completeness thereof.
<br />4.10 Prompt ~vritten notice shatl be giaen b~~ the O~vner
<br />to the Architect if the O«~ner becomes a«~are of an~~ fault or
<br />defect in the Project or nonconforntance ~~~ith the Contract
<br />Documents.
<br />4.11 The proposed language of certificates or
<br />certifications requested of the Architect or Architect's
<br />consultants shall be submitted to the Ar~~ii~t fo~r r~~~e~v~~nd
<br />approval at least 14 days prior to executton! ~['he ~tvner
<br />shall not request certifications that «ould require knowledge
<br />or services be}~ond the scope of this Agreement. ~
<br />ARTICLE 5
<br />CONSTRUCTIO COST
<br />5.1 OEFINITION
<br />5.1.1 The Gonstruction Cost s all be the tota( cost or
<br />estimated cost to the O~vner of a( elements of the Project
<br />designed or specified b5~ the Archit t.
<br />5.1.2 The Constcuction Cost all include the cost at
<br />current market rates of labor and iaterials furnished bti~ the
<br />O~ti~ner and equipmenl design . speciGed, selected or
<br />speciall~ pro~~ided for b~~ lhe Ar hitect_ plus a reasonab(c
<br />allo~vance for the Contractor's o~erhead and profit. In
<br />addition. a reasonable allo~rance r contingencies shall be
<br />included for market conditions at t e time of bidding and for
<br />changes in the Work during const ction.
<br />5.1.3 Constcuction Cost d s not inc(ude the
<br />compensation of lhe Architect an Architect's consultants,
<br />tlie costs of the land, rights-of-~a~a financing or other costs
<br />~~~hich are the responsibilih~ of t O~~ner as provided in
<br />ARicle 4. ~
<br />5.2 RESPONSIBILITY FOR CONSTRUCTION

<br />5.2.1 Evaluations of the O vner's Projecl budget,
<br />pretiminary_ estimates of Consiru tion Cost and detailed
<br />estimates of Construction Cost, f am•. prepared by the
<br />Architect, represent the Architeci's t judgment as a design
<br />professional familiar «-ith lhe co truction industq~. It is
<br />recognized, however, that neithe the Architect nor the
<br />O~~~ner has control o~~er the co of labor. materiats or
<br />equipment, over the Contractor's m thods of determining bid
<br />prices, or over competiti~~e biddin , market or negotiating
<br />conditions. According(}~, the Arch' ect cannot and dces nol
<br />~~•arrant or represent that bids or egotiated prices «~ill not
<br />~•an' from the Owner's Project budg t or from an}~ estimate of
<br />Construction Cost or e~~atuation pr pared or agreed to b~~ the
<br />Arcltitect.
<br />5.2.2 No fi~ed limit of Con truction Cost shall be
<br />established as a condition of his Agreement b~~ lhe
<br />furnisliing, proposa( or establishn ent of a Project budget.
