o(an increase in (he Contract Sum occurring after execution <br />of thc Contract Cor Construction. <br />; 3 [f lhe Bidding or Negotialion Pliase has not <br />enced wilhin 90 days after the Architect submits tlie <br />lruction Documents to the O~t~ner, an}~ Project budget or <br />ftxed limit of Construction Cost shall be adjusted to reflect <br />changes in the general teve( of prices in the construction <br />industn~ bet~veen ihe date of submission of the Construction <br />Documents to the O~~~ner and the dale on ~rhich proposals <br />are sought. <br />5.2.4 [f a fixed limit of Construction Cost (adjusted as <br />proaided in Subparagrapli ~.2_3) is e~ceeded bti~ the lo~~~est <br />bona fide bid or negotialed proposal, the O~~~ner shall: <br />.1 give ~~~ritten approval oC an increase in such fixed <br />limit; <br />.2 authorize rebidding or renegotiatir~g of the Project <br />«~ithin a reasonable time; <br />.3 if the Project is abandoned, terminate in accordance <br />~~~ith Paragraph 8.3; or <br />.4 cooperate in re~~ising the Project scope and quality <br />as required to reduce the Construction Cost. <br />5.5 [f the O~vner chooses to proceed under Clause <br />,4, the Architecl, ~vithout additional charge, shall <br />fv the Contract Documents as necessaR~ to comp(}~ ~vith <br />the fi~ed limit, if established as a condition of this <br />Agreement. The modification of Contract Documents shall <br />be the limit of the Archilect's responsibilily arising out of the <br />establishment of a fixed timil.
