(c) An owner shall reimburse the Association for any <br />expenditures incurred in repairing or replacing any <br />common element and/or facility damaged through his <br />fault, not otherwise covered by insurance policies <br />carried by the Association for the owner's and <br />Association's benefit. <br />(d) An owner may contract with another owner or a third <br />party to perform the maintenance and repair <br />required hereunder, but no such contract shall <br />relieve such owner from responsibility to perform <br />such work. <br />7. RIGHT OF ENTRY• ENCROACHMENTS• EASEMENTS FOR MAINTENANCE. <br />(a) In case of any emergency originating in or <br />threatening his unit, an owner shall grant the <br />right of entry to the management agent or to any <br />other person authorized by the Board of Directors <br />or the Association, whether the owner is present at <br />the time or not. <br />(b) An easement is reserved to the Association in and <br />through any office unit and the common elements <br />providing access at reasonable times and with <br />reasonable notice for purposes of maintenance, <br />repair and replacement of the common elements. If, <br />in the process of such repair and maintenance by <br />the Association, it is necessary to alter or damage <br />any unit or common elements, such alterations or <br />damages will be permitted without compensation, <br />provided the unit and/or common elements are <br />promptly restored to substantially their prior <br />condition by the Association. <br />(c) If any portion of the common elements encroaches <br />upon a unit, or a unit encroaches upon any portion <br />of the common elements, a valid easement for the <br />encroachment and for the maintenance of the same, <br />so long as it stands, shall be and does exist. In <br />~- ~• the event the structures are partially or totally <br />destroyed and then rebuilt, the owners of the units <br />agree that minor encroachment of parts of the <br />common elements due to such rebuilding shall be <br />allowed and an easement shall exist for such <br />purpose. <br />8. DISPROPORTIONATE MAINTENANCE COSTS. Notwithstanding the <br />general rules otherwise set forth in the Declaration and these <br />Bylaws, the common expense of maintenance, repair and replacement <br />of the general common element Hearing Room, together with the <br />BYLAWS'OF COURTHOUSE SQUARE CONDOMINIUM <br />PAGE - 14 <br />
