It is recommended that the minimum elements of a funding participation agreement include: <br />Maximum funding under the agreement shall be limited to an amount not greater than <br />$2,000,000. <br />2. Marion County/Salem Area Transit shall remove the existing transit transfer facility in High <br />Street and restore parking, and assume any cost thereof which may exceed limits of the <br />funding agreement. <br />Construction elements shall be publicly bid in conformance with applicable Oregon laws. <br />4. Each construction item shall be listed as a separate line item in the bid documents with at <br />least as much detail as contained in the request for funding cost estimate. <br />Construction elements subject to funding shall be listed by line item as an attachment to the <br />agreement. <br />6. Streetscape improvements for Chemeketa Street shall be separated from the other three block <br />faces such that it may be bid separately in such event there is a construction rime difference <br />between the public and private development of the project. A temporary sidewalk shall be <br />installed and the abutting lot graded, seeded, and maintained during such interim period of <br />time. <br />7. Approval of the Agency will be obtained by Marion County/Salem Area Transit prior to <br />award of a construction contract for the items to be funded by the Agency. <br />8. All payments to Marion County/Salem Area Transit shall be made only upon filing evidence <br />that work has been completed and a construction contract progress payment made for the <br />items to be funded. <br />9. Compensation for professional engineering and architectural services shall be limited to an <br />amount of six percent of construction bid cost of the streetscape improvements listed in the <br />request for funding. <br />10. Marion County/Salem Area Transit assume responsibility for the regular cleaning, <br />maintenance and repair of the streetscape hard surface improvements, landscape and street <br />furniture located within the public right-of-way of each block face surrounding the <br />Courthouse Square project. <br />
