3.3 Evidence of Payment. Mortgagor shall promptly furnish <br />of taxes and assessments, if any, to Mortgagee on its demand and shall auth <br />county official to deliver to Mortgagee at any time a written statement of the t <br />against the Property. <br />4. PROPERTY DAMAGE INSURANCE <br />4.1 Maintenance of Insurance. Mortgagor shall procure and <br />coverage with respect to the Mortgagor's interest in the Property as required un <br />lence of payment <br />° the appropriate <br />and assessments <br />intain insurance <br />the Agreement. <br />4.4 A~plication of Proceeds. Proceeds of any insurance sha 1 be paid by the <br />Mortgagor to the Mortgagee to the extent needed to prepay any Certificates pursuant to the <br />Agreement in the event the Property is damaged or destroyed and the Mortgagor el cts not to repair <br />and restore the Property. <br />4.2 Association of Unit Owners. Pursuant to the submission the Property to <br />condominium ownership, the insurance required pursuant to this Section 4 may e carried by the <br />association of unit owners on Mortgagor's behalf, and the proceeds of such insur ce may be paid <br />to the association of unit owners for the purpose of repairing or reconstructing the Property. If not <br />so used by the association, such proceeds shall be paid to the Mortgagor to the xtent needed to <br />prepay any Certificates in accordance with the terms of the Agreement. , <br />5. WARRANTIES OF MORTGAGOR <br />5.1 Title. Mortgagor warrants that it holds an undivided sixty ei ht and seventy- <br />one one-hundredths percent (68.71 %) interest in the Property as a tenant in co on, free of all <br />encumbrances other than those set forth in the attached Exhibit B(the "Permitted ncumbrances"). <br />5.2 Defense of Title. Subject to the exceptions in the paragraph a ove, Mortgagor <br />warrants and will forever defend its undivided interest in the Properiy against the awFul claims of <br />all persons. In the event any action or proceeding is commenced that questi s Mortgagor's <br />undivided interest in the Property or the interest of Mortgagee under this Mortgage, ortgagor shall <br />defend the action at its expense. <br />6. CONDEMNATION <br />6.1 Anplication of Net Proceeds. The Net Proceeds (as defined in the <br />Agreement) resulting from any condemnation of the Property or any portion there f shall be paid <br />by the Mortgagor to the Mortgagee to the extent needed to prepay any Certificates pursuant to the <br />Agreement as a result of such condemnation. <br />MORTGAGE I <br />PacE 4 <br />
