SALEM COURTHOUSE SQUAR~ NC. SECTION 00900 <br />Abatement GENERAL CONDTI'IONS <br />1997 PAGE 3 OF 6 <br />907 WORKERS' COMPENSATION: As provided by Oregon Laws, it is a condition of this contract that <br />all employers working under this contract aze subject employers that will comply with ORS chapter 656. <br />The contractor shall obtain and maintain at all times during the term of this contract, workers' <br />compensation insurance with statutory limits and employers' liability insurance. The CONTRACTOR <br />shall provide the OWNER with evidence that it is a carrier- insured or self-insured employer in full <br />compliance with the requirements of ORS Chapter 656, or that it employs no persons subject to the <br />requirements of ORS 656, Workers' Compensation Coverage. <br />908 PATENTS: As a condition to entering into the contract agreement, the CONTRACTOR assumes full <br />responsibility for any applicable licensing agreement that may be required to accomplish the work set <br />forth within the technical specifications when any device or process specified herein or required by the <br />work is subject to a United States Patent or Trademark. The process and devices specified wi[hin the <br />technical specifications are not intended to grant any rights to the CONTRACTOR. The <br />CONTRACTOR agrees upon entering into the contract to obtain any required ]icensing agreements <br />enforceable under the U.S. patents or Trademark, and further the CONTRACTOR, and his surety, agree <br />to hold the OWNER and Technica] Consultant harmless for damages for Patent or Trademark <br />infringement including cost for attorneys fees of said OWNER or Technical Consultant. <br />909 QUALITY OF THE WORK: The CONTRACTOR shall prosecute the work in diligent fashion and <br />perform all aspects of the work in a worker like manner in accordance with accepted industry standards. <br />Products and equipmen[ used in the work shall be used in compliance with the manufacturer's <br />instructions. Products and equipment used in the work shall be used in compliance with the <br />manufacturer's instructions. Portions of the work not meeting the requirements above or [he <br />requirements cited elsewhere in the specifications shall be subject to rejection by the OWNER or his <br />representative. The CONTRACTOR shall promptly correct such portions of the work to the specified <br />condition at no addi[ional cost to the OWNER. <br />910 USE OF PREMISES: The CONTRACTOR and his representatives shall comply with the regulations <br />of the OWNER regazding access routes, working hours, and employee conduct wile in or on the <br />premises. Work shall be performed under this contract in a manner that shall not unreasonably interrupt <br />or interfere with the normal use of the facility. <br />911 SUPERINTENDENCE BY CONTRACTOR: The CONTRACTOR shall give his personal <br />superintendence to the work or have a competent foreman or superintendent, satisfactory to the <br />OWNER, on the work at all times during progress, with authority to ac[ on the CONTRACTOR'S <br />behalf. <br />912 WARRANTY: The CONTRACTOR shall guuantee materials and workmanship against all defects for <br />a one (1) year period following final acceptance of the work. Where other portions of the specifications <br />required an extended warranty period for specific features of the work, that extended period shall apply. <br />913 INSURANCE: The CONTRACTOR shall maintain at contractors expense, and in force for the term of <br />the con[ract, Commercial General Liability Insurance covering bodily injury, property damage, <br />contractual and personal injury for the indemnity provided under this contrac[ and products/completed <br />operations liability for his own operations and vehicles and on work he may sublet to others. The CGL <br />policy combined with or under a sepazate policy will include pollution liability, and shall include <br />coverage for liability azising out of abatement removal and operations, including but not limited to <br />(Asbestos, Lead Paint, Oil, Fuels of all kinds).
