The OWNER shall promptly investigate the conditions, and if the OWNER finds that such <br />conditions do materially so differ and cause an increase or decrease in the CONTRACTOR'S cost of, or <br />the time required for, performance of the work under this contract, an equitable adjustment shall be <br />made and the contr~act modified accordingly. <br />b) No claim of the CONTRACTOR under this clause shall be allowed unless the CONTRACTOR has <br />given the notice required in (a) above. <br />c) No claim by the CONTRACTOR for an equitable adjustment hereunder shall be allowed if asserted <br />after final payment under this contract. <br />926 CONTRACT ENFORC~M~NT: In the event the OWNER fails to strictly enforce any of the terms of <br />conditions of this agreement, such conduct shall not be deemed a waiver of those terms or conditions nor <br />a waiver of the CONTRACTOR's breach thereof. <br />927 CONTRACT SUCCESSION: This agreement shall insure to the benefit of the parties, their heirs, <br />successors and assigns. Not withstanding the foregoing, this contract is personal to the CONTRACTOR <br />and the CONTRACTOR shall not be entitled to assign its rights hereunder without the express written <br />authorization of the OWNER. <br />928 NOTIFICATION OF TESTING: When necessaiy, testing services are provided by the OWNER <br />through a separate agreement, the CONTRACTOR shall notify the OWNER 24 hours in advance of the <br />time that test services are needed to allow adequate scheduling of equipment and personnel. <br />929 PROJECT SP~CITICATIONS: The CONTRACTOR shall maintain on-site complete copies of the <br />contract documents including any Proposal Addenda, contract modifications or official directives that <br />may be issued. The CONTRACTOR shall be responsible for having examined the contract documents <br />and for maintaining familiarity with their requirements. Should errors, omissions or conflicts occur in <br />the contract requirements, the matter shall be promptly brought to the attention of the OWNER for his <br />determination, however, the more restrictive interpretation of conflicting requirements shall generally be <br />considered to apply. <br />930 T~D~RAL TRANSPORTATION ACT CONTRACT REOUIREMENTS: The parties agree to <br />comply with the Federal Transportation Act contract requirements set forth in the Addendum to Contract <br />FI'A Contract Requirements. A copy of the Addendum is attached hereto and is incorporated by this <br />reference. <br />~ND OF S~CTION <br />
