Because this decision allows the separation of a dwelling <br />that could have been used as a second farm-related dwelling <br />should the property be intensely farmed in the future, no <br />additional farm-related dwellings shall be approved on the <br />16 acre parcel. ~ <br /> <br />The partitioning shall comply with ail requirements of the <br />Marion County Building Inspection Division. Prior to filing <br />the partitioning map, the applicant shall check with the <br />Marion County Building Inspection Division and the Planning <br />Division to ensure that the new property lines are not <br />located too close to a structure or septic drainfield. <br /> <br />Prior to submitting the final partitioning map the applicant <br />shall remove the illegal momt easterly access and improve <br />the other access for the one acre parcel to meet the <br />requirements of the Public Works Department. <br /> <br /> PROCEDURE: The Marion County Subdivision and Partition Ordinance <br /> provides that certain Partition applications be considered first <br /> by the County Planning Director. If there is any doubt that the <br /> application conforms with adopted land use policies and regula- <br /> tions the Director must condition or deny the application. Any <br /> interested person who disagrees with the Director's decision may <br /> request that the application be considered by the Marion County <br /> Hearings Officer after a public hearing. The applicant may also <br /> request reconsideration on the basis of new information subject <br /> to signing a waiver of the 120 day time limit for review of <br /> zoning applications. A public hearing is held on appeals subject <br /> to the appellant paying a $25.00 fee. Requests for reconsider- <br /> ~tion, or consideration by the Hearings Officer, must be in <br /> writing and be received in the Marion Coun, t~y Plannipg Division, <br /> <br /> . This decision is effective <br />/~? unless ~u~the~ consXde~ation is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The property is designated Special Agriculture in the Marion <br />County Comprehensive Plan. The purpose of the Special <br />Agriculture des/gnat/on and the corresponding SA (SPECIAL <br />AGRICULTURE) Zone ~s to encourage the continuation of <br />commercial agricultural activity and prevent the <br />establishment of use~ which hinder farming. The creation of <br />new homesites is not encouraged because residential uses are <br />often incompatible with the existing or potential farm use <br />of nearby lands. <br /> <br />The property is located on the north side of Aumsville <br />Highway at its intersection with Witzel Road. The subject <br />I?.1 acre parcel contains one dwelling, one mobile home, and <br />several accessory structures. <br /> <br /> <br />
