Findings of Fact <br /> <br /> The Hearings Officer, after careful consideration of the <br />testimony and evidence in the pecord, issues the following <br />findings of fact: <br /> <br />The subject property consists of a 210' x 240' parcel <br />identified as a Rural Residential Community in the <br />Marion County Comprehensive Plan and zoned AR (Acreage <br />Residential). The parcel is located on the south side <br />of Arndt Road, and currently contains the Butteville <br />Community Church, and a parsonage situated immediately <br />to the west of the church. <br /> <br />Surrounding properties to the north, west and south lie <br />in the AR zone, and are either timbered or are dedicated <br />to acreage homesites. Properties to the east lay in an <br />EFU (Exclusive Farm Use) zone, and are farm or timber <br />parcels. <br /> <br />Applicants propose to place a,mobile home on the subject <br />property to be used as a church office and Sunday school. <br />classrooms. <br /> <br />V. Additional Findings of Fact and Conclusions of Law <br /> <br />MCZ0 (Marion County Zoning Ordinance) 128.030(1) allows <br />churches and related facilities as conditional uses in <br />that zone. Conditional uses must meet the requirements <br />of MCZ0 Chapte~ 119. <br /> <br />MCZ0 l19.070(b) requires that the proposed conditional <br />use must be in harmony with the purpose and intent of <br />the zone. The purpose of the acreage residential zone <br />is to provide for orderly residential development and to <br />provide uses which directly serve such residential <br />areas. The existing church has served the Butteville <br />community in the past, and merely wishes to expand its <br />facilities to accomodate the community activities which <br />the existing church has already outgrown. There is <br />nothing to suggest that the intended expansion of the <br />existing conditional use would not be in harmony with <br />the purpose and intent of this zone. <br /> <br />Certain conditions on approval are necessary, in the <br />interest of the public health, safety and welfare. <br /> <br />VI. Order <br /> <br /> It is hereby found that applicants have met the burden of <br />proving the relevant standards and criteria, and therefore, it is <br /> <br />CU 87-56/ORDER - 2 <br /> <br /> <br />
