The applicant shall sign and submit a Declaratory Statement <br />to the Planning Division. This statement shall be recorded <br />by the applicant with the Marion County Clerk after it has <br />been reviewed and signed by the Planning Director (Declarat- <br />ory Statement enclosed). <br /> <br />The applicant shall file a Statement of Water Rights when the <br />partition map is filed with the County Clerk. The Statement <br />of Water Rights form and information on this requirement are <br />enclosed. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the <br />following conditions must be continually satisfied: <br /> <br />After the final Partitioning map has been recorded no <br />alteration of property lines shall be permitted without first <br />obtaining approval from the Planning Director. <br /> <br />A special dwelling setback of ~0 feet shall be maintained <br />from the north property line of Parcel 1. <br /> <br />OTHER PERMITS AND RESTRICTIONS: This approval does not remove or <br />affect any covenants or restrictions imposed on the subject <br />property by deed or other instrument. The proposed use may require <br />permits from other local, State or Federal agencies. This decision <br />does not take the place of, or relieve the responsibility for <br />obtaining other permits or satisfying any restrictions or condit- <br />ions thereon. It is recommended that the agencies mentioned in <br />Finding ~6 below be contacted to identify restrictions or necessary <br />permits. The applicant is advised of the followinq: <br /> <br />The applicant should contact the Sublimity Fire District and <br />obtain a copy of the District's Recommended Building Access <br />and Identification Guidelines. For personal and property <br />safety it ~s r~commended that the applicant follow these <br />~ldeltnes. <br /> <br />PROCEDURE: The Marion County Subdivision and Partitioning <br />Ordinance provides that c~rtain Partition applications be con- <br />sidered first by the County Planning Director. If there is any <br />doubt that the application conforms with adopted land uae policies <br />and regulations the Director must condition or deny the applicat- <br />ion. Any interested person who disagrees with the Director's <br />decision may request that the application be considered by the <br />Marion· County Hearings Officer after a public hearing. The <br />applicant may also request reconsideration on the basis of new <br />information sub3ect to signing a waiver of the 120 day time limit <br />for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $25.00 fee.
