PARTITIONING <br /> <br />Under MCSPO, Section I~I, when considering a partition <br />plan, the Eearings Qfficer shall consider whether the <br />partition is in accordance with the adopted ordinances, <br />comprehensive plans; and land development policies of <br />Marion County. The: Hearings Officer may condition or <br />modify plans to bring the plans into conformance with <br />regulations and ordinances. <br /> <br />MCZO Chapter %71, governing the P zone contains no <br />special requirements for land divisions, but any <br />resulting parcel must be able to meet relevant P zone <br />development standards. <br /> <br />The P zone has a minimum lot size of one acre for <br />dwellings. No dwelling is proposed in this case, but <br />the proposed one acrs parcel would meet this standard if <br />a dwelling is proposed in the future. The P zone also <br />limits lot area coverage so that no main building, such <br />as that proposed, can exceed 30 percent of the lot area. <br />The proposed building is approximately 6,000 square feet <br />in area which is well within the 13,100 square foot lot <br />area coverage limit:on the one acre. The parcel can <br />also accommodate applicable front, side and rear yard <br />setbacks and parking requirements. The proposed one <br />acre parcel is consistent with the lot standards of the <br />P zone and can be approved. <br /> <br /> 5. According to ORS 92.095, no partitioning plat shall be <br /> recorded unless all'ad valorem taxes have been paid <br /> which hsve become a ilien upon the land or which will <br /> become a lien durin~ the tax year~ Payment of <br /> appropriate taxes will be a condition of any approval. <br /> The 1995-96 taxes must be paid prior to filing of the <br /> final plat. <br /> <br />CONDITIONAL USE <br /> <br />Under MCZO 119.070, b~fore granting a conditional use, <br />the Hearing~ Officer must determine: <br /> <br />(a) That the Hearings Officer has the power to grant <br /> the conditional use; <br /> <br />(b) That such conditional use, as described by ~he <br /> applicant, will be in harmony with the purpose and <br /> intent of the zone; <br /> <br />CU/P 95-68~AMENDED ORDBR - 3 <br />BENNETT i <br /> <br /> <br />
