Under either option A or B above, the appropriate steps and process to perfect a pledge <br />would be as follows: <br />a. The City Council receive a recommendation of the Downtown Development <br />Advisory Board for funding. <br />b. City Council approve the recommendation and request the Transit District and <br />Marion County amend the current participation agreement by reducing the <br />maximum $2,000,000 participation by an amount equal to the pledge for the art <br />project. <br />c. Establish an intergovernmental agreement with the Transit District for <br />reimbursement of fabrication and placement of art work in the exterior plaza of <br />Courthouse Square. <br />5. Expenditure of Urban Renewal funds are restricted to the cost of design and construction of <br />capital improvements. Public art is an eligible capital improvement. For the Renewal <br />Agency to expend public funds, the capital improvement must be procured through a public <br />bid process consistent with both State laws and regulations. <br />The Committee has released a Request for Proposals. For the Agency to consider <br />participation the proposal, its content, advertising, and selection/award process must all be <br />in conformance with minimum State and City requirements. The RFP has been briefly <br />reviewed by the City of Salem Purchasing Division. Although the RFP has been patterned <br />after RFP's issued by the City of Portland and reviewed by the Transit District, several <br />questions remain as to whether all City of Salem requirements have been met. <br />Should City Council e~ect to participate in funding the Courthouse Square art project, it <br />would be necessary for the Transit District, through implementation of the <br />intergovernmental agreement, to certify that the minimum public bidding standards of the <br />State of Oregon and the Transit District have been met in the procurement, fabrication and <br />placement of the art work. <br />6. The Downtown Development Advisory Board received and discussed the request for <br />participation in the Courthouse Square art at its meeting of May 25, 2000. The Board <br />unanimously recommended that City Council authorize a$58,000 participation in the <br />Courthouse Square art project through the Riverfront/Downtown Urban Renewal Program <br />by amending the existing construction agreement and creating a new agreement with the <br />Transit District for the art work. <br />/ l <br />~ . /~ /~ ~ ~/ / /~' <br />i hard A.
