2.7 Capacity Constraints: _ <br />CONTRACTOR shall not impose: 1) Restrictions on the number of trips an individual will be provided; `""~ <br />2) Waiting lists for access to the service; or 3) Any operational pattem or practice that significantly <br />limits the availabiliry of service to program participants such asl without limitation: ~ <br />a) ShortaSe of drivers or dispatchers; <br />b) Insufficient number of vehicles available; <br />c) Prioritization of program participant trips; and, <br />d) Failure to discipline program participants who violate nashow policy. <br />CONTRACTOR shall provide at least 95 percent of program participants' trip requests. <br />2.8 Response Time: Scheduling and Reservation Call-in Requirements <br />CONTRACTOR's personnel are responsible for scheduling and dispatching CherryLift trips. <br />Resenrations will be accepted during normal business hours Monday through Saturday, 8:00 a.m. to <br />5:00 p.m., and Sunday 1:00 p.m. to 5:00 p.m. A CherryLift customer must reserve their trip by 5:00 <br />p.m. the day prior to requested service. Reservations may be made up to 14 days in advance of the <br />trip. <br />CONTRACTOR is required to record the program participant ID number, actual and scheduled pick-up <br />times, drop-off times, trip origins and destinations, on the dispatch log. CONTRACTOR shall record <br />the number of requests denied. CONTRACTOR will submit trip logs along with invoices for payment. <br />2.9 Subscription Service <br />CONTRACTOR may require program participants who frequently ride to participate in a regularly <br />scheduled CherryLift trip. Subscription service may not consume more than 50 percent of the total <br />CherryLift trips available at a given time of day, unless there is non-subscription capacity. Subscribers <br />will be program participants who travel one or more days to the same destination at the same time <br />each week. The CONTRACTOR may develop waiting lists or other capacity constraints and trip <br />purpose restrictions on program participants for the subscription services only. CONTRACTOR shall <br />reduce the amount of subscription service if the provision of such results in CherryLift capacity <br />constraints for other program participants. <br />The DISTRICT reserves the right to change the percentage of subscription service supplied to program <br />participants. <br />2.10 Late Cancellations and No-Shows <br />A no-show is defined as any program participant who fails to notify CONTRACTOR that they have <br />elected not to make a trip: (1) Any program participant who is not at the designated point of pick-up; <br />(2) Any program participant who is not ready to travel from the designated pick-up point; (3) <br />Customer cancels a trip less than 60 minutes from scheduled pick-up time; (4) Driver is told at the <br />point of pick-up that the program participant is not going. <br />CHERRYLIFf CONTRACT 108 AGREEMENT#1296.
