1~110!1997 1~:~9
. I
5~~-29?-28~5
H~NN:~ tv1CELD04~~NE'Y
y.r, 'vi"~
PAGE 04
Application of th~ 309fo limit on houschold income results in an estimate of $135.00 per month.
Based on thi~ minimum income estimate and the replacement hausing determination, Mr. Heinle
would be eligible for a maximum rent supplemeat payment of a7,350.00 ($310 -$135 = 5175
x 42). However, this amount is above the statutory maximum of $5,250 and would put Mr.
Heinle in 'hou~ing of last resort".
Housing of Last Resort is only used when there is no available housing within the relocatee's
financial means. However, Mr. Heinle and Jody Naff have rented replacemenc housing for
5495.00 per mor~th at a time when the relocadon housing study found a number of apartment
units available for substandally lawtr rent. This is prima facie evidence ihat replacement
housing is, and was, available within Mr. Heinle's financial means. Tlierefore, last resort
housing would not apply.
Marion County has an interest in resolving this relocadoa benefit dispute and closiog this
relocation file. Although we cannot determine the exact amount of Mr. Heinle's gross monthly
household income, the payment of S5,250 based on the income estimate above is considered
rea.gonable. Be~ause he has rtasanably substantiat.ed his household income and meets the
requirements of the relocation act, he is likely to prevail on appeal. ere ore, I recommen~
a rental supplement payment to Mr. Heinle of SS,250 plus SS5.00 for the non-refundable carpet
cleaning fee. in addition, he is eligible for his self move in the amount af 5550.00.
If you have any questions, please call me at 297-4588.
Sincerely,
~a._.~
Roger znna
Relocation Consultant
~ ~~
~, ~ ,,,,
~~
~ 5r._..~._-
~ ~
,~~`~~ ~
