selection of the lowest qualified bidder and show in the course of doing it that we had some <br />competitive selection process. <br />~"~ Rand had one <br />y concern that we might be paying twice for something. If Staton complies with <br />their contract to backfill, and if for some reason we can't let them proceed, approve a change <br />order or the need to meet OSHA requirements dictate they fill in the basemen~s, then we will <br />have to come back and pay someone else to take it out. We don't want to pay a premium price <br />to dig a hole, fill in and then turn around to pay someone else to take it out later. <br />Discussions were held regarding the mobilization of Pence/Kelly to start the basement removal <br />and hot spot remediation. There is concern that there could be a break in time with a stop in the <br />project. Dave would have to competitively bid contractors. The process approved with FTA <br />would have the general contractor bring in three bids and the review team would look at them. <br />It is not a true competitive bid, no advertising, etc. It has to be bid whether Pence/Kelly or the <br />county does it. It was felt that if there would be a break between Pence/Kelly coming on site <br />and remediation, it made more sense to go to the second option. <br />Why can't they collapse the walls in onto the basement floors? Some of the rubble <br />materials aze being used as shoring against the walls. The original intent was to leave the walls <br />and basements in place. Why? The original specs were written that way. A change order <br />needs to be issued to cover the change from the original specs to haul the materials away. The <br />rubble is composed of floors in the Community Development building and other structures. <br />Staton has no problem to do a number of things, but the hauling away of this rubble was not <br />included in the original contract. Discussion was held about Pence/Kelly doing this work and <br />they might have same issue with OSHA. Staton can't leave site with holes vwithout putting <br />additional hard siding or fencing around the open basements. This is a big risk issue for the <br />county. <br />Staton contract also calls for removal of sidewalks and leaving curbs as a groundwater issue. <br />There is not as much concern in this area as we have more information today. <br />David Hartwig added that it may not be a significant amount of material either way. <br />Pence/Kelly added that someone has to haul it away one way or another. Concems of paying <br />for something twice surfaced again. How many dollars are we talking? Kathleen has <br />contacted another contractor from a suggestion from Pence/Kelly last week. They will provide <br />the information to Pence/Kelly, but needed written specs to bid against. <br />Concerns surfaced that there is not a clean transition from the demolition process to the actual <br />construction phase. We can't sacrifice the FTA grant. We need to make sure we aomply in the <br />process to protect the FTA funds. We have the time now to look for a way to get the best <br />transition from one contractor to another without paying more money. Basement and wall <br />removal is a separate project and was not included in specs when other bidders preser~ted bids, so <br />it is difficult to do a change order. <br />John will call Nick Hockens at FTA to get a clarification about selection process for this item to <br />Page 3 of 4 <br />
